Thanks for using Beckon. We take the respect and protection of your privacy and security very seriously. We are committed to following and continuously evolving best practices to support this principle.

We – meaning Beckon, Inc., (also “we”, “our” or “us”) – prepared this Privacy Policy to help you understand our practices with respect to the collection, use, and disclosure of information we collect from you when you use the Beckon platform at https://app.beckon.com (the “Beckon Platform”) and our website at https://beckon.com (“Website”) that links to this Privacy Policy, and any other services we provide to our customers or end users (collectively with the Beckon Platform, the “Services”).

By accessing or using the Services, you agree to this Privacy Policy and our Terms of Service.

WHAT INFORMATION WE COLLECT

Information related to the creation of user accounts in the Beckon Platform or that otherwise identifies you as a user of the Beckon Platform, or that you provide to us to obtain our Services, is what we call “User Information.” User Information includes certain personal data such as your name, email address, phone number, and title.

If you are a user of the Beckon Platform we may collect and process information about you on behalf of the Beckon customer (typically your employer) with whom your use of the Services is associated. If your account gets created using a third-party service (such as Google or a single sign-on service such as Okta or Active Directory), we may collect User Information about you from the third-party service (such as your username or user ID associated with that third-party service).

If you express an interest in obtaining additional information about our Services, use our web contact form, sign up for an event or webinar, or download certain content, we generally require you to provide us with your User Information.

Other non-personally identifiable data that a user submits or uploads to the Beckon Platform or otherwise provides to Beckon is not considered personal data.

INFORMATION COLLECTED AUTOMATICALLY THROUGH YOUR USE OF THE SERVICES

We collect information about how you use the Services and your actions on the Services, including IP addresses, what software and hardware you use (such as browser types, operating systems, ISPs, platform type, device type, mobile device identifiers such as make and model, mobile carrier), pages or features of the Services used, associated dates and time stamps, links you click, and other statistics related to your usage of the Services. We may use third party tools and partners to collect this information.

Some of this information is collected through the use of “cookies” and other tracking technologies, such as web beacons, session replay scripts, and similar technologies as set forth below in the Cookies and Tracking Technologies Section.

COOKIES AND TRACKING TECHNOLOGIES

Cookies. We collect information about you through the way in which your computer interacts with our systems. A cookie is a small piece of data that is stored on a user’s computer for activity-tracking purposes. We use persistent and session cookies on the Services. A session cookie expires when you close your browser. A persistent cookie remains on your hard drive through the expiration time of the cookie or until you delete it. Your web browser allows you to remove persistent cookies should you wish to do so. We use session cookies to make it easier for you to navigate the Services. Persistent cookies are often used to store user preferences or may allow you to stay logged into the Beckon Platform for a certain period of time, or track your use of the Services over time.

We sometimes use cookies delivered by us or third parties to show you ads for our products that we think may interest you on any devices you may use and to track the performance of our advertisements. For example, in these cases, cookies may collect and remember information such as which browsers have visited our websites. The information provided to third parties does not include personal data, but this information may be re-associated with personal data after the we receive it.

You can instruct your browser to disallow cookies. Please note that if you disable your browser’s ability to accept cookies, you will not be able to use the Beckon Platform. The Beckon Platform also does not respond to or follow browser do not track signals.

Web beacons. Third parties employ Web beacons on our website. Web beacons are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web users. Unlike cookies, which are stored on a user’s computer hard drive, Web beacons are embedded invisibly in webpages or emails. We use Web beacons to operate, track, and improve the Services and email communications.

JavaScript code. The main purpose of JavaScript code is to provide you with advanced functionality within the Beckon Platform and on our Website. JavaScript code can also be used by third parties and Beckon to collect standard Web browser information (such as the browser type or operating system), as well as your browsing experience (such as the time to fully render a page). You can instruct your web browser to disable JavaScript but this will make it impossible for you to use the Beckon Platform since it is integral to it.

Web server logs and IP addresses. We maintain and track usage of the Services through web server logs and other internally developed tools. These logs provide information such as user browser type, viewed pages, requests you made to the platform or website, and results of such requests. We use IP addresses to analyze trends, administer the Services, track user’s movement, and gather broad demographic information for aggregate use. We use this information to improve the content and usability of the Services. We may use anonymized or aggregated derivations of this information to identify future Service features and functionality and to provide better customer service. We link this information to the personal information you’ve stored in the Beckon Platform. We reserve the right to share aggregate and anonymous information with third parties.

Google Analytics. Some of the Services which refer to this Privacy Policy use Google Analytics. Google Analytics uses cookies, JavaScript code, and other tracking technologies. The information generated with help of the cookie about your use of the Services (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Website, compiling reports on site activity for site operators, and providing other services relating to site activity and usage.

Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google.

Google has developed the Google Analytics Opt-out Browser Add-on. It provides visitors to the Services more choice on how their data is collected by Google Analytics. The add-on communicates with the Google Analytics JavaScript (ga.js) to indicate that information about the website visit should not be sent to Google Analytics. LOCATION INFORMATION

We may collect limited location information. For example, we may use Google Analytics to convert your IP address into a rough geolocation to understand in what areas our users are located and to improve and personalize the Services (for example, to display time data in the correct local time).

SENSITIVE DATA

Our Terms of Service prohibit customers from using the Beckon Platform to collect, manage, or process Sensitive Information and we use reasonable efforts to prohibit customers that sign other agreements with us from such practice. We are not responsible for our customers’ use of information they upload to the Beckon Platform. “Sensitive Information” refers to Social Security numbers, passport numbers, driver’s license numbers or similar personal identifiers, racial or ethnic origin, physical or mental health condition or information, or other employment, financial or health information.

HOW WE USE THE INFORMATION WE COLLECT

We use the information we collect for a variety of purposes, and how we use it depends on what we collect and how you use the Services.

We use your personal data as follows:

  • Where it is necessary for the performance of our contract with you or your employer, for the use of our Websites, and to fulfill our obligations under the applicable terms of use/service; where we have not entered into a contract with you or your employer, we base the processing of your personal data on our legitimate interest to operate and administer our Services and to provide you with content you access and request (e.g., download of certain content from our Websites).
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests. For example, when we carry out fraud screening or contact you to provide you with support.
  • Where we need to comply with a legal or regulatory obligation. For example, keeping records of our sales for tax compliance.
  • Where we have your consent such as for certain cookies or in relation to sending certain direct marketing communications. Where our legal basis is consent, you have the right to withdraw consent any time.

These purposes include:

  • Providing the Services to you
  • Responding to requests or inquiries from you
  • Providing customer support or technical assistance
  • Contacting you to provide product updates and information you have requested
  • Creating or administering your account, including identifying you with your account
  • Deriving user insights, ways to improve the Services, and other business analysis or research purposes
  • Customizing existing and future product offerings and other aspects of the Services to you and other users
  • Improving our Services
  • Securing the Beckon Platform and our systems, and protecting your information and data
  • Any legitimate business purpose, such as when information is aggregated and anonymized

PUBLIC FORUMS AND CUSTOMER TESTIMONIALS

Beckon may provide bulletin boards, blogs, or comment sections on our Services. Any personal data you choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages. Beckon is not responsible for how the personal data you choose to submit in these forums is used or further disclosed.

Beckon posts customer testimonials, which may contain personal data, on the Services. We obtain the customer’s consent prior to posting a corresponding testimonial.

DISCLOSURE OF INFORMATION COLLECTED

Service Providers. Beckon may provide personal data to our contracted service providers so that these service providers can provide services on our behalf. These service providers are authorized to use your personal information only as necessary to provide the requested services to us. For example, we use AWS for hosting our Services and we use Marketo to help us send emails to you. You should review the privacy policies of such third parties to understand how they use your data.

Feedback. If you send us a request, inquiry, feedback, or other comments (for example via a support email), We reserve the right to edit and re-publish it in our training materials, which may be displayed on our Services, in order to help us support you and other users with similar issues in an anonymized fashion.

Obligated Disclosures. We will disclose your personal data (a) if we are required to do so by law, regulation, or other government authority, or otherwise in cooperation with a new or an ongoing investigation of a governmental authority and (b) to enforce our terms of service or to protect our rights.

Merger. We may transfer your personal data to an affiliate or a successor entity upon a merger, consolidation, or other corporate reorganization in which we participate or to a purchaser or acquirer of all or substantially all of our business or assets.

HOW WE SECURE YOUR INFORMATION

Unfortunately, no security measures are 100% foolproof, and as such no network or system (including ours) can be guaranteed to be 100% secure against destruction, loss, alteration, unauthorized disclosure of, or access to information we collect and store.

Beckon maintains a comprehensive and audited compliance and security program according to the SOC 2 standard. For more details about security at Beckon please also refer to (link to security standards).

DATA RETENTION

We will only keep your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

By law we have to keep basic information about our customers, such as payment data, generally for seven years after they stop being customers, for tax purposes. We generally retain our Beckon customer data for as long as they remain a customer and for 90 days thereafter, and we retain marketing contact data for leads that have not become Beckon customers for six months. Please note that we may retain information that is otherwise deleted in anonymized and aggregated form, in archived or backup copies as required pursuant to records retention obligations, or otherwise as required by law.

COMMUNICATIONS PREFERENCES

You may manage your receipt of marketing and non-transactional communications by sending a request to opt-out to support@beckon.com or we may provide facilities for self-service within communications that we send or within the Beckon Platform. Users who have subscribed to the Beckon Platform cannot opt out of receiving transactional emails related to their account.

INTERNATIONAL TRANSFERS (INCLUDING TRANSFERS OUTSIDE OF THE EUROPEAN UNION)

We process and store information on servers located in the United States. By using the Services, you consent to the transfer of information (including User Information) to locations that may be outside of your country of residence, including the United States. The European Union’s General Data Protection Regulation (“GDPR”) allows for transfer of personal data from the European Union to a third country in certain situations. By agreeing to this Privacy Policy, you agree to the transfer of all such information to the United States of America, which may not offer an equivalent level of protection to that required in other countries, particularly within the European Union, and to the processing of that information by Beckon on servers located in the United States of America as described in this Privacy Policy. In our discretion, we may adopt other means, such as entering into data processing agreements that include the EU Standard Contractual Clauses or enter into different certification programs under applicable law for ensuring adequate safeguards.

YOUR RIGHTS

If the General Data Protection Regulation applies to you because you are in the European Union, you have rights under data protection laws in relation to your personal data:

  • The right to be informed – that’s an obligation on us to inform you how we use your personal data (and that’s what we’re doing that in this privacy policy);
  • The right of access – that’s a right to make you a copy of the personal data we hold about you, known as a ‘data subject access request”;
  • The right to rectification – that’s a right to make us correct personal data about you that may be incomplete or inaccurate;
  • The right to erasure – that’s also known as the ‘right to be forgotten’ where in certain circumstances you can ask us to delete the personal data we have about you (unless there’s an overriding legal reason we need to keep it);
  • The right to restrict processing – that’s a right for you in certain circumstances to ask us to suspend processing personal data;
  • The right to data portability – that’s a right for you to ask us for a copy of your personal data in a common format (for example, a .csv file);
  • The right to object – that’s a right for you to object to us processing your personal data (for example, if you object to us processing your data for direct marketing); and
  • Rights in relation to automated decision making and profiling – that’s a right you have for us to be transparent about any profiling we do, or any automated decision making.

These rights are subject to certain rules around when you can exercise them. You can see a lot more information on them, if you are interested, on the UK Information Commissioner’s Office website. If you wish to exercise any of the rights set out above, please contact us (see the Questions section below for how to contact us).

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

You have the right to make a complaint at any time to the supervisory authority for data protection issues in your country of residence. We would, however, appreciate the chance to deal with your concerns before you approach the supervisory authority so please contact us in the first instance.

MANAGING YOUR INFORMATION

Even if you are not in the European Union, our customers may access, correct, amend, or delete your personal information other than your email address within the Beckon Platform by editing their user or organization record. To update a user profile and registration information, please sign in at https://app.beckon.com/login with your email and password, then click the person icon in top right corner and select “Profile.”

INFORMATION FROM CHILDREN

Beckon is not directed to children under the age of 16 and we do not knowingly collect personal data from children under the age of 16. If we learn that we have collected personal data of a child under the age 16, we will take reasonable steps to delete such information from our files as soon as is practicable. Please contact us at privacy@beckon.com if you believe we have any information from or about a child under the age of 16.

LINKS TO THIRD-PARTY SITES

Our Services may provide links to other Web sites or resources over which Beckon does not have control (“External Web Sites”). Such links do not constitute an endorsement by Beckon of those External Web Sites. You acknowledge that Beckon is providing these links to you only as a convenience, and further agree that Beckon is not responsible for the content of such External Web Sites. Your use of External Web Sites is subject to the terms of use and privacy policies located on the link(s) to External Web Sites.

CHANGES TO PRIVACY POLICY

Any information that we collect is subject to the Privacy Policy in effect at the time such information is collected. We may, however, revise the Privacy Policy from time to time. If a revision is material, as determined solely by us, we will notify you, for example via email and/or a change notice on the Services. The current version will be posted to our Privacy Policy page.
